Abstract

This case became known as the principle of state liability or the "Frankovic rule" in European Union law. EU Member States are responsible for complying with European legislation and for transposing the provisions of the directives of the European Union into their national legislation within the deadline. The Italian government had breached its obligations and was liable to compensate the workers' loss resulting from the breach.
